
Commercial Lead

- Review and possess a detailed understanding of the commercial elements and contracting philosophy and principles for the Company's standard forms of contract which may include reimbursable, not-to-exceed, fixed price, lump sum, or similar commercial models.
- For proposals, in consultation with the Contracts Lead, derive the optimal contracting model for contracting with the Client, including investigating and developing a detailed understanding of applicable taxation liabilities (particularly withholding tax) for the various contracting options.
- For proposals, assess foreign exchange control and risks, and understand the flow of funds for the project, and specifically from the Client to the Company and the Companies subconsultants and subcontractors.
- For proposals, determine appropriate strategies, budgets, and activities to mitigate risks to the Company associated with foreign exchange variation, retentions, insurances, warranties, bonds and securities.
- For proposals, determine the applicable local, site labour rates and labour burden costs, and generate the applicable hourly selling rate for use in the budget.
- For proposals, compile the commercial outcome model for presentation with key stakeholders, as required.
- For awarded work, assist the project teams in the formation, administration, management and close-out of Company contracts with Clients, as well as the best practises and processes with regards to contract management.
- For awarded work, ensure that all contract management activities are conducted within ethical and Company standards, and in compliance with jurisdictional statutory and regulatory requirements.
- For awarded work, resolve commercial issues to ensure maximization of commercial performance on every project, aligned with the commercial strategy and processes of the project.
- For awarded work, provide recommendations on the appropriate actions to mitigate and/or manage commercial disputes, variations and or claims.
- For awarded work, monitor and assist projects with change management to ensure timely development, submission and conclusion of scope changes.
- For awarded work, monitor and administer rate review periods and associated adjustments with the assigned project team.
- For awarded work, assume full responsibility for Client invoicing, including ensuring invoices are compiled and submitted in accordance with Company, Client and contract specifications, as well as monitoring and expediting payments, as supported by the Finance group.
- In consultation with the People and Finance groups, annually or as required, compile and analyse the Company's commercial terms, primarily the Company's hourly selling rates for various offices and operating jurisdictions, which requires a detailed understanding of both fixed and multiplier-based calculation methods as well as Consumer Price Index and similar published and industry recognized metrics to support periodic rate reviews.
- Possess a thorough understanding of the Company's intercompany framework agreements, work sharing and intercompany billing policies and practices as they relate to the satisfactory performance of the position requirements.
- Conduct formal annual reviews of each Project Manager and each Study Managers performance in relation to commercial management of the Company's direct contracts with our Clients.
- Control the effective implementation of the commercial framework and processes, monitoring and reporting on project delivery against the requirements of the contract.
- Prepare a monthly Commercial report including updates on commercial related progress and performance and issues, concerns, variations, disputes and or claims.
- Laise with other office resources for contracts, commercial and legal, and site roles if required.
- Facilitate relationships with a range of key stakeholders and maintain effective client management by positively responding to internal and external stakeholder needs.
