- Oversee and manage litigation cases and claims.
- Support business strategy while minimizing legal risk.
- Communicate with CarMax personnel and opposing attorney offices on disputes related to legal claims.
- Independently analyze information and applicable law related to legal claims in order to make strategic decisions on next steps and resolution.
- Negotiate the resolution of legal matters with customers and opposing counsel.
- Review and draft correspondence to customers and opposing counsel that sets forth CarMaxās legal position in response to claims.
- Research, review and draft responses to regulatory complaints.
- Interview and prepare CarMax witnesses for depositions and court proceedings.
- Retain and oversee CarMax outside counsel related to litigation management and strategy.
- Work with CarMax outside counsel to prepare for court appearances, including motions hearings and trials. Attend court appearances as needed.
- Prepare for and attend settlement conferences and mediations as CarMax representative.
- Assist CarMax outside counsel with drafting legal documents, discovery responses, discovery requests, pleadings, motions, and briefs. Ensure that CarMaxās legal position is effectively stated.
- Review and approve responses to subpoenas and other document requests.
- Maintain expertise and manage matters in unique areas of responsibility, which may include intellectual property, personal injury, recoveries, real estate, construction, and credit and collections.
- Maintain strong relationships and work with CarMax corporate management, including Customer Relations, Public Relations, and Asset Protection, in order to resolve legal disputes.
- Maintain strong relationships with CarMax store management and regional personnel and work with them to resolve customer legal disputes and litigation.
- Have proficient understanding of CarMax store operations and systems in order to best resolve claims and locate needed information to research legal claims.
- Work with internal CarMax departments to manage and resolve legal claims and regulatory disputes.
- Manage and develop paralegals.
- Play an active role in associate development for the litigation team.
- College degree and law degree required.
- Membership in good standing with the bar of a U.S. Jurisdiction
- Minimum 5 years litigation experience; consumer law experience preferred but not required.
- Exceptional communication (written and oral) and interpersonal skills and ability to express ideas effectively in individual and group situations. Writes in a style that is professional and polished.
- Ability to develop creative solutions to difficult problems. Ability to make effective and independent judgments.
- Strong leadership and relationship-building skills with internal and external partners.
